1. Sponsor and Definitions

The “Sponsor” is 10199931 Canada Inc., doing business as Shop 4 Charity. The Sponsor in its sole and absolute discretion may engage various third parties to handle various aspects of the Sweepstakes on its behalf. In these Official Rules, where the context permits or requires, the term “Sponsor” includes those third parties.

Sweepstakes Draw Code” means a unique 8-digit numeric code that evidences entry into the Sweepstakes and will be used for draw purposes. The “Entry Code” is a 12 digit alphanumeric code that is provided to potential entrants when a Calendar (defined below) is purchased through a corporate program. All times mentioned in these Official Rules are Pacific Time (“PT”) unless otherwise specified. The “Entry Period” begins on September 18, 2017 at 12:00:01 a.m. PT (i.e. midnight) and ends on January 26, 2018, with earlier entry deadlines applicable to certain prizes, as set out in more detail below.

2. Eligibility

The Sweepstakes is open only to individuals who are: (a) legal residents of Canada (excluding residents of the province of Quebec); and (b) over the age of majority in his/her province or territory of residence; and (c) located within Canada (excluding the province of Quebec) at the time of entry.

You are NOT eligible to enter the Sweepstakes if, at any time on or after September 1, 2017, you are or were: (a) a director, officer, employee, representative or agent of Sponsor, or any of their respective parent, subsidiaries, affiliates, or service agencies, any entity engaged in the development, production or distribution of materials for the Sweepstakes, or any other entity engaged in the promotion, advertisement, administration or execution of this Sweepstakes (collectively the “Sweepstakes Entities”); or (b) the member of any immediate families (defined as parents, siblings, children, and spouses, regardless of where they live) or households (whether or not related) of any of the foregoing such persons.

The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Sweepstakes. Failure to provide such proof may result in disqualification. 2 26045454.9

3. How To Enter

No purchase or payment is necessary to enter or win. A purchase will not increase your chances of winning.

A. To Enter the Sweepstakes with Purchase: To enter the Sweepstakes by purchasing a Calendar, go online to sweepstakesforthecure.ca (the “Official Website”) or by phone, call 1-855-248-9831, or submit an order form by mail to Shop4Charity 2018 Calendar Sweepstakes, P.O. Box 10, Brockville, ON, Canada K6V 5T8, and purchase a Sweepstakes calendar (the “Calendar”). You may purchase a Calendar for yourself (the “Purchaser”), or for someone else (the “Calendar Recipient”). To enter, the Purchaser must provide his/her full name, complete address, and telephone number (including area code) to Sponsor. For a Calendar Recipient to be eligible to win instead of the Purchaser, the Purchaser must provide the Calendar recipient’s name, telephone number and contact information (address and/or email if provided) to Sponsor. Only if the identity of the Calendar Recipient is disclosed to Sponsor, and if the Calendar Recipient agrees to, and complies with, these Official Rules, will he or she be eligible to win. If the Purchaser does not provide Sponsor with Calendar Recipient’s name and/or contact information before any draw date, then the Purchaser will be deemed the entrant.

Once the applicable entrant has provided the requisite information, Calendar Recipient or Purchaser will receive one (1) unique Sweepstakes Draw Code evidencing such Entry (“Entry” and collectively, the “Entries”) for each Calendar. Calendar(s), including the unique Sweepstakes Draw Code(s) evidencing entry into the Calendar Sweepstakes, will be mailed to the entrant specified in the order within twenty (20) business days from order date. If Calendar(s) and/or Sweepstakes Draw Code(s) are not received within twenty-five (25) business days, entrant should contact the Sponsor to follow up on the order. Note that all communications with Sponsor will be between the entrant and the Sponsor or its agent only. Sponsor is not authorized to contact or to communicate with any third party (including but not limited to relatives of the declared entrant).

B. To Enter the Sweepstakes without Purchase: To enter the Sweepstakes without purchasing a Calendar, send a hand-written Entry by mail to: Shop4Charity 2018 Calendar Sweepstakes, P.O. Box 10, Brockville, ON, Canada K6V 5T8, Attn: 2018 Calendar Sweepstakes Entry Request. Your Entry must be legibly hand-printed or written on a blank 8.5” x 11” piece of paper, and must include: (a) an original essay of 200-250 words about why you think it is important to support cancer research and awareness (the “Essay”); and (b) your full name, complete mailing address, telephone number (including area code), and a valid email address. Each Essay must be a hand-printed, original composition by the entrant, written specifically for the Sweepstakes and only be submitted once. You must also include your return address on the exterior of the envelope, which must be legibly hand-printed in ink. Each Entry must be in a separate outer stamped envelope. Entries that are photocopied, hand-stamped, computer-generated, or otherwise mechanically produced or reproduced, without a legible postmark, or that are not printed or written manually 3 26045454.9

in ink, will NOT be honoured and will be deemed void. Upon receipt of a valid Sweepstakes entry request, you will receive one (1) Entry into the Sweepstakes, and will receive a unique Sweepstakes Draw Code evidencing such Entry for each valid request received. The Sweepstakes Draw Code will be emailed to each entrant within twenty (20) business days from receipt of the valid request. Please check your email and spam filters. If Sweepstakes Draw Code is not received within twenty-five (25) business days please contact the Sponsor. LIMIT: one (1) no-purchase entry per person per day during the Entry Period. Each Entry request must be postmarked during the Entry Period, on or before the applicable Entry Deadline and received no later than five (5) business days following the applicable Entry Deadline, as set out in Rule 4 below.

C. To Enter the Sweepstakes with an Entry Code (Corporate Program): Individuals may alternatively have the opportunity to enter the Sweepstakes through a corporate program. Calendars may be pre-purchased by corporate partners and distributed by such partners for free to individuals (also “Calendar Recipients”) selected in the corporate sponsor’s sole discretion. Calendars distributed via this method will include a unique 12 digit alphanumeric entry code (each an “Entry Code” and collectively, the “Entry Codes”). Upon receipt of a Calendar, Calendar Recipients must go to the following page on the Official Website, sweepstakesforthecure.ca/activiateform.aspx to enter the Entry Code (during the Entry Period) along with the individual’s full name, complete address, telephone number (including area code), and a valid email address. Once Calendar Recipient has provided and submitted the requisite information he/she will receive one (1) unique Sweepstakes Draw Code evidencing such Entry for each unique and valid Entry Code submitted. Sweepstakes Draw Code(s) will be emailed to the Calendar Recipient within twenty (20) business days of entry. Please check email and spam filters. If Sweepstakes Draw Code(s) is not received within twenty-five (25) business days please contact the Sponsor. LIMIT one (1) Entry per Entry Code. Note that failure to enter the requisite information as described above by the applicable entry deadline (see below) may result in voiding of the Entry Code and forfeiture of the chance to win.

D. General: Each Sweepstakes Draw Code and Entry Code can only be used one (1) time. All Entry Codes and Sweepstakes Draw Codes shall be subject to verification and shall be null and void if they are found to not have been obtained or submitted in accordance with these Official Rules. Sponsor is not responsible for late, lost, damaged, mutilated, garbled, undelivered, or postage due Sweepstakes Draw Codes, Entry Codes or Entry requests. No mechanical reproductions of Entry Codes or Sweepstakes Draw Codes permitted. Use of automated devices is prohibited; automated Entries (including but not limited to Entries submitted using any robot, script, macro or other automated service) are not permitted and may result in disqualification. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and by the decisions of the Sponsor in respect to the Sweepstakes, which decisions shall be final and binding with respect to all aspects of the Sweepstakes. of a dispute as to the identity of the person who submitted any Entry, the authorized account holder of the email address submitted at entry will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an access provider, service provider, or other person or organization responsible for assigning email addresses for the account associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.

4. Entry Deadlines, Prize Draws and Winner Selection

** $10,000,000 PINK BALL DRAW: On September 14, 2018 at 9:00 a.m. PT (i.e. 12:00 noon ET), the Sponsor will conduct a random draw to select one (1) entrant to participate in the Pink Ball Draw. The selected entrant will then be entered immediately into the Pink Ball Prize Draw for the opportunity to win a cash prize of $10,000,000, or $25,000. Sponsor will randomly select one (1) pink ball from among the five hundred (500) pink balls available. Each of the five hundred (500) pink balls will have a pre-established cash value: one (1) ball will have a $10,000,000 pre-established cash prize value; and four hundred and ninety nine (499) balls will have a $25,000 pre-established cash prize value. The winner will be awarded the pre-established cash prize value associated with the ball drawn. Only one (1) cash prize will be awarded.

General: Winning a prize is contingent on complying with these Official Rules, including the prize claim conditions set out below. Selected participants and winners of all prizes will remain eligible for all future draws.

5. Winner Notification and Prize Claim Conditions

Before any potential winner can be declared a winner of any prize, he/she must first (i) correctly answer a time-limited mathematical skill-testing question (the “Skill-Testing Question”) without assistance of any kind whether mechanical, electronic or otherwise, and (ii) read, execute and return a declaration of eligibility/release of liability (the “Prize Claim Document”) to the 6 26045454.9

redemption centre (the “Redemption Centre”) by the date indicated on the Prize Claim Document.

The Sponsor will attempt to contact the potential winner by telephone within five (5) business days of the applicable draw dates described above or as otherwise determined by Sponsor. Once the potential winner is contacted, the Sponsor will schedule a mutually convenient time for the Sponsor to administer the required Skill-Testing Question to that individual, which must occur within eight (8) business days from the date of first contact. Following which, and provided the selected entrant correctly answers the Skill-Testing Question, the Sponsor will send that individual (via regular mail delivery and/or email to the addresses confirmed by the potential winner), the Prize Claim Document that the potential winner will be required to complete and return to the Redemption Centre, in a postage-paid envelope which the Redemption Centre will provide to him/her, by email or by fax. The Prize Claim Document will contain, among other things, a declaration of eligibility and compliance with the Official Rules, a liability release and a publicity release and must be actually received (properly completed and signed by the potential winner) by the Redemption Centre on or before the date specified in the Prize Claim Document. When the Redemption Centre receives the completed Prize Claim Document, the Redemption Centre will begin the verification process described in these Official Rules. It is planned that the Redemption Centre will inform the applicable entrant, if he/she is not a verified winner, within approximately twenty (20) business days from the date the completed Prize Claim Document and any other required materials are actually received by the Redemption Centre. If the potential winner is verified as a winner, the Redemption Centre will award the prize.

Return of any prize or winner notification as undeliverable, inability to reach selected entrant or failure of selected entrant to respond to notification within five (5) business days of first attempt by Sponsor, failure to provide proof of eligibility (if requested), Prize Claim Document, or other required documentation by the specified deadline, failure to complete the Prize Claim Document, failure to correctly answer the Skill-Testing Question, or other non-compliance with these Official Rules may result in disqualification, forfeiture of the prize and, at the Sponsor’s sole discretion, selection of an alternate entrant, who will be eligible to receive the forfeited prize but who will be subject to disqualification in the same manner described above. In the event an entrant is so disqualified, the entrant will have no claim against the Sponsor or any other person respecting the forfeited prize or the Sweepstakes.

6. Prizes

The number of prizes available to be won will diminish as the prizes are awarded. The odds of winning depend on the number of eligible entries received by the applicable Entry Deadline, unless otherwise stated below. All prizes must be accepted as awarded, except Sponsor reserves the right to substitute any prize with an alternate prize (or vehicle model) of equal or greater 7 26045454.9

monetary value if the prize cannot be awarded for any reason. Prizes are not transferable by the winner and may not be redeemed for cash or otherwise.

All vehicle prizes will either be delivered to the address of the verified winner, or be available for pick-up at a dealer closest to the winner’s place of residence, in the Sponsor’s sole discretion. Winner (or designate) may be required to show proof of license and insurance prior to claiming a vehicle prize.

For all travel prizes (VIP Prize, Weekly Prizes) winner and guest(s) must travel together on the same itinerary and are responsible for all required travel documents prior to ticketing. Winners are responsible for any additional expenses associated with the prize not expressly stated as included below. The actual value of travel may vary depending on point of departure, date of booking and other factors; winner is not entitled to the difference (if any) between the actual and approximate prize value. The winner and his/her travel guests must be Canadian residents to qualify for the prize.

A. VIP PRIZE: One (1) VIP Prize available to be won consisting of one (1) trip for four (4) adults to Riviera Maya, Mexico. Approximate retail value (“ARV”) of VIP Prize: $8,000 based on sample Toronto departure. Actual retail value may vary depending on the departure date & city. The VIP Prize includes the following:

The winner and his/her travel guests must have the right to enter the destination. A minimum of one (1) person, either the VIP Prize winner or one of the travel guests, must hold a valid credit card to cover any incidentals or any other requirements that may be required at the hotel. Ground transfers to and from the winner and/or travelling guest’s residence and designated airport and all other expenses not specified herein or listed within the travel brochure, including but not limited to meals, telephone or fax, gratuities, optional tours, taxes and fees, insurance, medical travel documents, personal expenses, and any other costs not specifically stated herein as being included, are the sole responsibility of the winner and his/her guests. In the eventuality that the VIP Prize winner and his/her guests resides in a city that requires transportation to Air Transat 8 26045454.9

departure cities, the costs associated with such transportation are the winner’s and his/her guest’s entire responsibility. No extensions will be permitted and the prize cannot be exchanged, transferred or substituted for cash except that Transat reserves the right to offer a comparable product in the event of a vacation package cancellation, Act of God or other unforeseen circumstances. The prize winner shall not be entitled to receive, in cash, certificate or otherwise, the balance of any amount representing the difference of the prize retail value and actual cost. No frequent flyer miles will be available.

B. EARLY BONUS PRIZE: One (1) Early Bonus Prize consisting of a 2018 FIAT 124 Spider Classica vehicle (ARV $35,404 CAD).

ARV is approximate; dealers may sell for less. Additional terms and conditions and other restrictions will apply. Prize vehicle may not be exactly as shown in promotional materials. Sponsor reserves the right to substitute a vehicle of equivalent or greater monetary value, or a vehicle of different colour or model year, if Sponsor is unable to award the prize as described, including, but not limited to: production delays caused by labour disruptions, part shortages, adverse weather conditions or other unforeseen events, end of model year availability, and for any other reason.

Sponsor disclaims any warranty, representation or guarantee express or implied by fact or in law relative to any prize, including but not limited to its quality and condition, except where prohibited by law. Any other costs or expenses not specifically described as being included in the prize (including, but not limited to licensing, insurance registration and all other costs associated with any upgrade or option packages the winner may request) will be the responsibility of selected winner.

C. EARLY BIRD PRIZE: There are five (5) Early Bird Prizes available to be won, each consisting of $10,000 cash.

D. DAILY PRIZE: There are three hundred and sixty-five (365) Daily Prizes available to be won, each consisting of $1,000 cash.

E. WEEKLY PRIZE: There are fifty-two (52) Weekly Prizes available to be won, divided into twelve (12) trips (“Trips”) and fourty (40) travel vouchers (“Vouchers”).

7. Limitations of Liability

By participating in the Sweepstakes, entrants release and agree to hold the Sweepstakes Entities, and every director, officer, employee, agent, manager and member of any one or more of the Sweepstakes Entities harmless from and against any and all costs, injuries, losses or damages (including without limitation direct, indirect, incidental, consequential or punitive damages) of any kind, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or in any activity related to the Sweepstakes, or due in whole or part to the receipt, possession, use or misuse of any prize. 8. General Disclosures

A. Power or Other Interruptions affecting Sweepstakes Entry: If there is a power or a computer-related interruption of any nature whatsoever before an Entry Code, which an Entrant has attempted to enter into the Sweepstakes, has actually been received and recorded by the Sweepstakes Computer (the “Sweepstakes Computer”), it is possible that the Entry Code may have been lost, and consequently forfeited. When power is restored or the interruption corrected, the Entrant who experienced the interruption should sign in to the Official Website and try to enter the applicable Entry Code to determine if that Entry Code or was received and recorded by the Sweepstakes Computer before the interruption occurred. If the applicable Entry Code was received and recorded by Sweepstakes Computer, an onscreen message will state that the Entry Code has already been entered into the Sweepstakes. By participating in the Sweepstakes and by submitting Prize Claim Documents, except where legally prohibited, each verified winner hereby agrees and grants the Sponsor the right, but not the obligation, to use his/her name, voice, and likeness, along with his/her address (city/town/village and province/territory) and any statements made by or attributed to such Winner in any and all media (including the internet), now known or hereafter devised, in perpetuity and throughout the universe, for advertising and promotional purposes in connection with the Sweepstakes without further notice, review, approval or compensation and releases the Sponsor and all directors, officers, employees, agents, advertising and promotional agencies, representatives, service agencies and independent contractors of the Sponsor from any and all liability with respect thereto.

It is each Entrant’s responsibility to ensure that he/she has complied in full with all the conditions and requirements contained in these Official Rules. The Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering or interfering in any way with the process involved in entering the Sweepstakes or with the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in any unsportsmanlike or disruptive manner, or with the apparent intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to abuse, threaten or harass any other person. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.

C. Force Majeure/Printing and Production Errors or Omissions

The Sponsor has the following rights in respect to termination or modification of the Sweepstakes. Sponsor reserves the right, without prior notice and at any time, to terminate the Sweepstakes, in whole or in part, or to modify, suspend or extend the Sweepstakes in any way and for any reason. Without limiting the generality of the foregoing, the Sponsor may terminate the Sweepstakes, whole or in part, or modify, suspend or extend the Sweepstakes, if it determines, in its sole discretion, that the Sweepstakes is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, glitches, or printing or production errors or omissions) have destroyed or severely undermined the proper play, integrity, and/or feasibility of the Sweepstakes. In the event the Sponsor is impeded or prevented from continuing with the Sweepstakes as planned or intended by any event beyond its control, including, but not limited to fire, flood, natural or manmade epidemic or health hazard or crisis, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, provincial, territorial or local government law, order, or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor’s control, then the Sponsor shall have the right to modify, suspend, extend or terminate the Sweepstakes. Only the number of prizes described in these Official Rules will be awarded in the Sweepstakes. The sole responsibility and liability of any irregular Entry Code or Sweepstakes Draw Code caused by the Sponsor, is replaced with another randomly selected Entry Code or Sweepstakes Draw Code, as solely determined by the Sponsor. Replacement shall be the sole and exclusive remedy under such circumstance. If, due to printing or production errors or omissions or for any other reason whatever, the number of potential prize winners coming forward seeking to claim prizes exceeds the number of prizes as set out in these Official Rules, in the sole discretion of Sponsor, the winner may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s).

D. Waiver and Invalidity

Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Rules shall not affect 18 26045454.9

the validity or enforceability of any other provision. In the event that a provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference, and shall not be deemed or considered to affect in any manner the meaning or intent of these Official Rules or any provision thereof.

9. Privacy

Information provided by entrants in connection with the Sweepstakes will be used for the purposes of Sweepstakes administration and prize fulfillment, and will be collected, used, and disclosed in accordance with the Sponsor’s privacy policy, available at shop4charity.com/privacypolicy.

Go Team Canada Contest

  1. TO ENTER the Roundhouse Radio 98.3 GO TEAM CANADA! contest (the “Contest”), listeners must “call in to win”. All “call in to win” times specified are in Pacific Standard Time. Limit of one (1) entry per individual. If it is discovered that you attempted to enter more than once, all your entries will be void.
  2. The Contest will run on-air, weekdays during the Mornings Show with Gene Valaitis (the “Host”) starting on October 23rd 2017 at 6:00 a.m. PST and closes on November 5th, 2017 at 5:00 p.m. PST, excluding statutory holidays (the “Contest Period”).   6. Prizes – There is one (1) grand prize available to be won (the “Grand Prize”), consisting of
    a)   two (2) Club Seat tickets to the scheduled Canada Soccer Canada v USA Womens’ soccer match scheduled for November 9th 2017 at BC Place Stadium;
    b)  two (2) Canada Soccer jerseys; and

  7. Prize(s) must be accepted as awarded and “as is” and are not redeemable for cash and cannot be resold for profit.   1. Grand Prize Draw: On Monday, November 6th, 2017, between 8:00 a.m. PST and 10:00 a.m. PST, a random draw for the Grand Prize will take place at the Contest Sponsor’s offices located at 714 Alexander Street, Vancouver, British Columbia from among all Qualifiers. The first entrant drawn will win the Grand Prize. The odds of winning the Grand Prize depend on the number of eligible Qualifiers. The Contest Sponsor, acting reasonably, will attempt to contact the potential Grand Prize winner to notify potential winner that he or she has won the Grand Prize by email immediately after the Grand Prize Draw or conversely, be called via telephone at the Qualifier provided telephone number during the Mornings Show between 8:00 a.m. PST and 10:00 a.m. PST. The potential grand prize winner will then have 24 hours (24) beginning from the sent receipt date to respond/confirm to said email.   1. Qualifying To Win: Only one qualifying entrant per person. The Qualifier may be announced on air and may be required to chat on-air at the discretion of Roundhouse Radio. If there is not a clear telephone connection between the Announcer and the Qualifier, such that one or each other cannot hear the other, such Qualifier will not be eligible to win the Grand Prize and the Contest Sponsor will not be liable in any way for such failed connection.  In conducting the Contest, the Announcer has the full and absolute discretion to disqualify any potential Prize winner who fails to respond on the phone or whose response cannot be heard.  Each Qualifier will then be required to provide a representative of the Contest Sponsor with their name, address, telephone number and e-mail for the purpose of confirming their identity in order to be eligible to win the Grand Prize.

 

  1. Proof of identification must be provided upon request. 3. The Contest sponsor is Roundhouse Radio 98.3 CIRH FM, (hereinafter referred to as the “Contest Sponsor”).

4. To enter and to be eligible to win, entrant must be a legal resident of one of the following Cities of Vancouver, Burnaby, North Vancouver, West Vancouver or Richmond, B.C. Canada and be nineteen (19) years of age or older and must have valid Government identification.

5. Employees and their parents, siblings and children, and persons domiciled with an employee of the Contest Sponsor, its agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to enter. A grand prize winner of a major Roundhouse Radio 98.3 contest such as the WHO LOVES YAH, BABY! are not eligible to win another Grand Prize for thirty (30) days following the end of this Contest (including persons designated by such winners to take ownership of prizes). Should this period differ from the Roundhouse Radio general rules, these alternate rule date periods shall apply.

7. Grand Prize Draw: On Wednesday, October 25, 2017, between 10:00 a.m. PST and 1:00 p.m. PST, a random draw for the Grand Prize will take place at the Contest Sponsor’s offices located at 714 Alexander Street, Vancouver, British Columbia from among all Qualifiers. The first entrant drawn will win the Grand Prize. The odds of winning the Grand Prize depend on the number of eligible Qualifiers. The Contest Sponsor, acting reasonably, will attempt to contact the potential Grand Prize winner to notify potential winner that he or she has won the Grand Prize by email immediately after the Grand Prize Draw or conversely, be called via telephone at the Qualifier provided a telephone number during the Midday Show between 10:00 a.m. PST and 1:00 p.m. PST on October 25th, 2017. The potential grand prize winner will then have 24 hours (24) beginning from the sent receipt date to respond/confirm to said email. In the event that the potential winner does not respond within the designated time allowance outlined above, he/she will be disqualified and an alternate potential winner may be drawn at the Contest Sponsor’s sole discretion.

8. Qualifying To Win: Only one qualifying entrant per person. The Qualifier may be announced on air and may be required to chat on-air at the discretion of Roundhouse Radio. If there is not a clear telephone connection between the Announcer and the Qualifier, such that one or each other cannot hear the other, such Qualifier will not be eligible to win the Grand Prize and the Contest Sponsor will not be liable in any way for such failed connection. In conducting the Contest, the Announcer has the full and absolute discretion to disqualify any potential Prize winner who fails to respond on the phone or whose response cannot be heard. Each Qualifier will then be required to provide a representative of the Contest Sponsor with their name, address, telephone number and e-mail for the purpose of confirming their identity in order to be eligible to win the Grand Prize.

9. Proof of identification must be provided upon request. Before being awarded a Prize, potential winner, may be required to sign and return within the time stipulated by the Contest Sponsor, a full release and indemnity form stating that he/she has read, understood and complied with these Rules, grants all consents required, authorizes the Contest Sponsor to broadcast, publish and disseminate his/her name, city of residence, photograph, likeness, sobriquet and voice, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the potential winner beyond the awarding of or participation in the Prize, accepts the Prize as offered and releases the Contest Sponsor from any and all liability of any kind arising out of the potential winner’s participation in this Contest and receipt and use of the Prize. In the event that the potential winner does not comply with all the provisions as contemplated in these Rules, Contest Sponsor shall have the right to disqualify potential winner and draw an alternate potential Prize winner and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner shall be applied, with the necessary amendments, until a qualified Prize winner has been duly selected.

All decisions of the Contest Sponsor with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest.

All entries become the property of Contest Sponsor who assumes no responsibility for garbled, inaudible lost, late, delayed, destroyed or misdirected mail, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting names of prize winners (for which a self-addressed, postage paid envelope must be included). Contest Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials-data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsor, in its sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, Contest Sponsor reserves its right to cancel, terminate, modify, amend, extend or suspend the Contest, including canceling any method of entry and select a qualifier and/or winner from previously received eligible entries. Contest Sponsor reserves its right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsor reserves its right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. To Health With You Contest Rules

1. TO ENTER the Roundhouse Radio 98.3 TO HEALTH WITH YOU! contest (the “Contest”), listeners must “call in to win”. All “call in to win” times specified are in Pacific Standard Time. Limit of one (1) entry per individual. If it is discovered that you attempted to enter more than once, all your entries will be void.

2. The Contest will run on-air, weekdays (3:00pm PST – 6:00pm PST) during the Janice & Cory Show (the “Host”) starting on October 18th 2017 at 3:00 p.m. PST and closes on October 31st, 2017 at 6:00 p.m. PST, excluding statutory holidays (the “Contest Period”). To enter the Contest, an eligible Participant must listen for the cue to call as provided from the Host throughout the Contest Term (the “Que to Call”) and call RHR’s contest number (604-449-8983). Contest Rules & Policy

1.1. 0971197 B.C. Ltd., doing business as “Roundhouse Radio” (“RHR”) is a low-power FM radio station broadcasting at 98.3 FM, serving the City of Vancouver.

1.2. RHR’s Contest Rules (the “Contest Rules”) set out the rules and regulations that shall apply to all contests facilitated by RHR (the “Contests”), unless otherwise provided.

1.3. If RHR implements rules and regulations with regards to a specific Contest that differ from the rules and regulations contained herein (the “Alternate Rules”), any discrepancies between the Contest Rules and the Alternate Rules shall be resolved in favour of the Alternate Rules if such Alternate Rules are made available to the public.

1.4. By entering a Contest, all Participants are deemed to have read and to have accepted the Contest Rules.

For the purpose of the Contest Rules, the words listed in sections 2.1 through 2.11 have the following meanings:

2.1. “Contest” means any and all contests facilitated by RHR, whether carried out in person, over the phone, online or otherwise;

2.2. “Daily Contest” means a Contest that is not a Major Contest;

2.3. “Employee” means an employee, contractor or pensioner of RHR;

2.4. “family member” has the same meaning as in the Family Law Act of British Columbia, as amended from time to time;

2.5. “Major Contest” means a Contest for which the Prize:

2.5.1 is a vacation; or

2.5.2. has a fair market value, as determined by RHR, of $500.00 or greater;

2.6. “ordinarily resident” means an individual who, at the relevant time, lives full-time or part-time in the relevant household;

2.7. “Participant” means an individual who is eligible to participate in a Contest in accordance with section 3, and who enters into such Contest in accordance with section 4;

2.8. “Personal Information” means information about a Participant, Potential Winner or Winner including, but not limited to, his or her name, age, address, and phone number. For greater certainty, “Personal Information” as defined herein does not have the same meaning as in RHR’s Privacy Policy;

2.9. “Potential Winner” means a Participant who successfully participates in accordance with section 4;

2.10. “Prize” means the physical item, privilege associated with such item, or opportunity to participate in an event or subsequent stage of a Contest, as described by RHR and awarded to the Winner of a Contest; and

2.11. “Winner” means a Potential Winner who:

2.11.1. successfully answers the time-limited mathematical skill testing question, in accordance with section 5.2; and

2.11.2. signs the standard release of waiver and liability in accordance with section 9.2.

Wherever the context so requires, the singular shall be read as if the plural were expressed, and vice-versa, as the context requires.

3.1. To be eligible to be a Participant, unless provided otherwise, an individual must be a legal resident of British Columbia and be at least 19 years of age.

3.2. If the Alternate Rules permit an individual under the age of 19 to be a Participant, such Participant must provide RHR with prior written consent and release of liability from his or her parent or legal guardian.

3.3. The following individuals are not eligible to be Participants:

3.3.1. an Employee, officer, director or shareholder of RHR;

3.3.2. third party contest sponsors and their employees, contractors, directors, officers, shareholders;

3.3.3. a Winner of a Daily Contest within the thirty (30) days immediately before the Winner of the Daily Contest in question is declared;

3.3.4. a Winner of a Major Contest within the thirty (30) days immediately before the Winner of the Major Contest in question is declared; or

3.3.5. a family member, as defined in section 2.4, of a person identified in

3.3.1. through 3.3.4;

3.3.6. an individual being an ordinarily resident, as defined in section 2.6, of the same household as an individual described in sections 3.3.1 through 3.3.4 above.

3.4. If at any time after being named a Winner RHR discovers that an individual was not eligible to be a Participant at the time they were declared a Winner (the “Relevant Time”), RHR reserves the right to disqualify the Winner. If, at such time, the Winner has collected his or her Prize from RHR, RHR has the right to demand that the Winner:

3.4.1. return such Prize to RHR in the same condition that the Prize was in at the Relevant Time; or

3.4.2. pay RHR the amount equal to the fair market value of such Prize, as determined by RHR as of the Relevant Time; as deemed appropriate in the sole discretion of RHR.

4.1. A Participant may enter a contest in person, over the phone, online or otherwise, as applicable to a particular contest. Participants may be notified of contests by listening to RHR or visiting RHR’s website where specific details on specific contests may be found as well as the process for selecting Winners or Potential Winners. Streaming listeners should be aware that they may be receiving a delayed stream of a radio signal which may vary depending on the specific computer being used and the available internet connect. RHR recommends that listeners tune in to RHR on the radio to ensure they are receiving content in real time. RHR and any applicable contest sponsors assume no responsibility for Participants not making timeline phone calls.

4.2. Only one entry per person per contest is permitted unless otherwise specified.

4.3. A Participant is not required to purchase anything, unless provided otherwise in the Alternate Rules.

4.4. Participants shall be responsible for any and all costs associated with entering a Contest, which may include, but are not limited to long-distance charges, data charges, SMS charges and other similar costs.

4.5. To enter a Contest, whether carried out in person, over the phone, online or otherwise, the Participant will be required to participate by:
4.5.1. providing RHR with Personal Information; and

4.5.2. answering a skill testing trivia question; or

4.5.3. performing a task as described by an Employee of RHR.

4.6. If the Participant fails to answer the skill testing trivia question or perform the task described by the Employee of RHR, he or she shall be disqualified from the Contest.

4.7. If the Contest requires that the Participant be the correct numbered caller through on RHR’s On Air Line, as available on RHR’s website, and such Participant is disqualified according to section 4.6 above, RHR shall give the next caller the opportunity to participate in the Contest, and so-on and so-forth.

5.1. A Participant may be declared a Potential Winner of the Contest immediately upon entering the Contest, in accordance with section 4.5 above, or by random draw.

5.2. After being declared a Potential Winner, the Potential Winner shall be required to answer, unaided, a time-limited mathematical skill testing question. If the Potential Winner correctly answers the above-mentioned skill testing question within the time allotted, he or she shall be declared the Winner of the Contest.

5.3. Some Contests may be carried out in stages, such that the Winner’s Prize of a preliminary Contest is the opportunity to be a Potential Winner of the final Contest. In such cases, a Winner of a preliminary Contest shall become a Potential Winner of the final Contest, with the Winner of such final Contest to be determined in accordance with sections 5.1 and 5.2 above.

5.4. RHR reserves the right to modify a Contest to enable a Winner to be declared or to carry the Prize over to a subsequent time or Contest.

6.1. The probability of being declared the Winner of any given Contest is dependent on the number of Participants or Potential Winners, as applicable and the number of Winners of the Contest.

7.1. The Winner’s Prize and any portions of a prize are non-exchangeable, non-transferable, non-refundable, have no cash surrender value and must be accepted as awarded and may not be sold.

7.2. The Winner shall collect his or her Prize in person either immediately on-site, if applicable, or at the RHR office within thirty (30) business days of being declared the Winner of the Contest. RHR is not required to deliver the prize to the Winner by mail, courier, or other means, but may do so at RHR’s sole discretion, and at the sole expense of the Winner.

7.3. If the Prize shall be picked up by the Winner in accordance with section
7.2 above:

7.3.1. RHR shall have the Prize available for pick up during regular business hours, as determined by RHR; and

7.3.2. the Winner must provide RHR with two (2) pieces valid of identification, one (1) of which must be government issued identification with a photograph.

7.4. RHR is not required to, but may in their sole discretion choose to, release the Prize to any individual who is not the Winner of the Contest, even if the Winner consents to such release.

7.5. Winners shall be responsible for all costs and expenses associated with, but not expressly forming part of, the Prize. Such costs and expenses include, but are not limited to, taxes, fees, gratuities, insurance, or travel to and from the airport where the Prize includes travel.

7.6. If the Prize includes travel, the Winner is responsible for ensuring that he or she, as well as his or her companion, if applicable has all of the necessary travel documents, immunizations, etc. required to travel to the destination on the dates specified in the description of the Prize.

7.7. RHR may, in its sole discretion, substitute a Prize or portion thereof with an alternate Prize (the “Alternate Prize”) of equal or greater value, as determined by RHR. The Alternate Prize may, if RHR so decides, be in the form of cash.

7.8. Not withstanding section 7.7 above, RHR shall not be responsible to substitute a prize or potion thereof where such Prize cannot be redeemed by the Winner due to factors beyond RHR’s reasonable control, which include, but are not limited to:

7.8.1. an event being cancelled;

7.8.2. a product being discontinued;

7.8.3. the Winner failing to collect the Prize prior to an event/expiration date; and

7.8.4. the Prize being lost in transit to RHR or to the Winner, if RHR agrees to deliver the Prize to the Winner by mail or courier in accordance with section 7.2.

8.1 None of the contest sponsors nor RHR or either of their affiliates make any representations or offers any warranty, express or implied, as to the quality or fitness of any prize. Winners acknowledge and agree that they may not seek reimbursement nor pursue any legal or equitable remedy from any of the contest sponsors, RHR, or their respective affiliates should the price fail to be fit for its purpose or be, in any way, unsatisfactory to the Winner.

9.1. The Participants, Potential Winners, and Winners of all Contests acknowledge that participating in a Contest or collection or use of the Prize may be inherently dangerous. All such individuals agree to release and hold harmless RHR, including RHR’s Employees, shareholders, officers, directors, agents and representatives, for any and all damage, loss or liability incurred by entering in a Contest or collecting or using the Prize.

9.2. The Winner of any Contest agrees to sign a standard release and waiver of liability prior to collecting his or her Prize, which will be provided by RHR. If the Winner is not of the age of 19, his or her parent or guardian agrees to sign the above-mentioned release and waiver of liability. If the Winner or Winner’s parent or guardian, as applicable, refuses to sign the above-mentioned release and waiver of liability, he or she will not be entitled to collect his or her Prize. The standard form of declaration and release of liability will confirm that by entering the Contest, the Winner:

9.2.1. has read, understood and accepted these Contest Rules;

9.2.2.understands that the acceptance of a Prize may involve danger and/or exposure to risks and hazards of both man-made and natural origin, whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, he or she may suffer damage to personal property, injury, illness or even death;

9.2.3.has nevertheless freely and voluntarily agreed and does agree to assume any and all risk of damage to personal property, injury, illness or even death arising out of or connected with his or her participating in a Contest; and

9.2.4. he or she releases the contest sponsors, RHR, and their respective affiliates, and all of their directors, officers, employees, and agents from any and all liability arising in connection with their participation in a Contest and their acceptance of a price including, without limitation, any financial, legal or moral responsibility or loss or personal injury including death or damage to or loss of property suffered or incurred or arising from the Participant’s participation in the Contest or the acceptance of the Prize, whether suffered by the Winner or by his or her heirs, administrators, personal representatives, executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission negligence, or gross negligence of any of the contest sponsors, RHR, and their respective affiliates, and all of their directors, officers, employees and agents.

10.1. By entering a Contest, each Participant consents to the collection and use of his or her Personal Information by RHR and RHR’s agents.

10.2. By entering the Contest and voluntarily providing personal information including, but not limited, his or her name, address, city, email address, home and office telephone number, the Participants, Potential Winners and Winner of a Contest consent to the collection and use of his or her name, photograph, likeness, testimonial, city of residence and voice by RHR and RHR’s agents, as deemed appropriate in RHR’s sole discretion, for the purposes of administering the Contest, selecting Potential Winners and Winners, as well as such other marketing and promotional purposes that RHR may determine in its sole discretion. The Winner consents to the use of the above-mentioned items without compensation whatsoever and without restricting the:

10.2.1. the time period during which;

10.2.2. the medium by which; and

10.2.3. the scope on which;
the above-mentioned items are used.

10.3. For the purpose of this section 10, “use” means the treatment, handling, and management of Personal Information or any of the items described in section 10.2 above by RHR and their agents.

10.4. By entering a Contest, each Participant, Potential Winner, and Winner agrees that it is their responsibility to be familiar with the privacy terms contained herein and in RHR’s Privacy Policy which is available on RHR’s website.

10.5. Subject to the above, all entries to a Context shall become the property of RHR and any applicable context sponsors.

11.1 RHR reserves the right to disqualify, from any Contest or future Context, any individual who tampers with or in any way corrupts the entry process and the operation of the Contest as outlined in these Contest Rules. RHR may prohibit an entrant or person they believe is tampering with a Contest or future Contest from participating in the Contest or winning a prize if, in RHR’s sole discretion, RHR determines that said potential Participant, Participant, Potential Winner or Winner is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any unfair playing practices (including the use of automated quick programs) or intending to annoy, abuse, threaten or harass any person associated with the Contest. Any attempt by an entrant or any other individual to deliberately damage a website or to undermine the legitimate operation of a Contest may be in violation of criminal and civil laws, and should any such attempt be made by a Contest entrant or other person, RHR reserves the right to seek remedies and damages or other relief (including lawyers’ fees) from any such Contest entrant or any other individual to the fullest extent permitted by law, including criminal prosecution.

11.2 Each Participant, Potential Winner and Winners agrees to abide by the terms of these Contest Rules which are subject to change at the sole discretion of RHR.

12.1. Subject to applicable law, RHR and any contest sponsors reserve the right, at their sole discretion, to cancel, terminate, modify or suspend any Contest, in whole or in part, without prior notice with no obligation or liability, including, if for any reason, the Contest is not capable of running as planned, whether due to technical failure, tampering, fraud, corruption of security or other causes beyond the control of RHR or any of the contest sponsors that corrupts, impairs or affects the administration, security, fairness, integrity or proper conduct of the Contest.

12.2. RHR Contests shall be void where prohibited by law and are subject to all federal, provincial, territorial, and municipal laws and regulations of Canada and of British Columbia and Vancouver, respectively.
